By accessing or using the renters.fyi website (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not accept these terms, please do not use the website.

2. Description of Service

Renters.fyi is a crowdsourced rental price transparency platform. Users submit rental information voluntarily to help others understand rental market pricing. The Service aggregates and displays this user-submitted data.

3. User-Submitted Content

By submitting rental information to the Service, you represent and warrant that:

  • The information you provide is accurate to the best of your knowledge
  • You have the right to share this information and are not violating any confidentiality agreements
  • Your submission does not contain false, misleading, or defamatory content
  • You are submitting information about a rental agreement you are or were party to, or have direct knowledge of

You grant renters.fyi a perpetual, worldwide, non-exclusive, royalty-free license to use, display, modify, and distribute your submitted content as part of the Service.

4. Data Accuracy Disclaimer

ALL INFORMATION DISPLAYED ON RENTERS.FYI IS USER-SUBMITTED AND UNVERIFIED. We do not independently verify the accuracy of rental submissions. The data should be used for informational purposes only and should not be the sole basis for any financial or housing decisions. We make no representations or warranties about the accuracy, completeness, or reliability of any user-submitted content.

5. Acceptable Use

You agree to use the Service for lawful purposes only. You shall not:

  • Submit false, misleading, or fraudulent information
  • Use automated systems or bots to submit data or scrape content
  • Attempt to identify, harass, or contact individuals based on submission data
  • Use the data for any discriminatory purpose, including but not limited to discrimination based on race, color, religion, sex, national origin, familial status, or disability
  • Use the Service in any way that violates applicable laws or regulations
  • Interfere with or disrupt the Service or its infrastructure

6. Fair Housing Compliance

Renters.fyi is committed to fair housing principles. The data provided on this Service must not be used in any manner that violates the Fair Housing Act or any applicable state or local fair housing laws. Users are prohibited from using our data to discriminate against any person based on race, color, religion, sex, national origin, familial status, disability, or any other protected class. If you become aware of any discriminatory use of our data, please report it to hello@renters.fyi.

7. Content Removal and Disputes

If you believe that information displayed on the Service is inaccurate, defamatory, or violates your rights, you may request its removal by contacting us at hello@renters.fyi with:

  • Identification of the specific content at issue
  • An explanation of why the content should be removed
  • Your contact information

We will review removal requests and take appropriate action at our sole discretion. We reserve the right to remove, modify, or decline to display any user-submitted content for any reason.

8. Intellectual Property

The Service, including its design, features, and aggregated data compilations, is owned by renters.fyi and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Service without our express written permission. Individual data points submitted by users remain factual information, but our compilation, presentation, and analysis of that data is proprietary.

9. No Warranty

THE SERVICE AND ALL INFORMATION PROVIDED ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RENTERS.FYI, ITS OWNERS, OPERATORS, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM:

  • The use of or inability to use the Service
  • Any information or materials available on the Service
  • Any decisions made based on information from the Service
  • Unauthorized access to or alteration of your submissions
  • Any third-party conduct on the Service

11. Indemnification

You agree to indemnify, defend, and hold harmless renters.fyi, its owners, operators, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your submissions to the Service; (c) your violation of these Terms; or (d) your violation of any rights of another party.

12. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may initiate binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13. Class Action Waiver

YOU AND RENTERS.FYI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and renters.fyi agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

14. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and renters.fyi regarding the use of the Service and supersede any prior agreements.

17. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time by posting the updated terms on this page and updating the "Last updated" date. Material changes will be noted at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of those changes.
